Game developer King isn’t satisfied with a chart-topping gameit also wants to own the rights to words in the title of its smash hit Candy Crush Saga.
A week after the U.S. Patent and Trademark Office approved for publication King’s trademark application for the term “Candy,” reports have tipped the company’s newest target: Stoic Studio’s(Opens in a new window) attempt to trademark “The Banner Saga(Opens in a new window),” a role-playing game.
Stoic applied for a trademark for The Banner Saga, but King is now objecting(Opens in a new window) to that application, arguing that use of the word “Saga” will confuse consumers and make them think The Banner Saga is associated with King.
King applied for(Opens in a new window) the “Saga” trademark in 2011, but the application process was suspended last year because King failed to provide a “copy of a foreign registration from applicant’s country of origin.” King is based in London.
Still, King argues that Stoic’s application should be denied. “Due to the similarity between [Stoic Studio’s] claimed mark, THE BANNER SAGA, and [King’s] SAGA Marks, the closely related nature of the goods and services of the respective parties, customers and potential customers are likely to believe that [Stoic’s] goods originate from [King], resulting in a likelihood of confusion in the marketplace, and damage to [King],” the Jan. 10 filing said.
King has already secured U.S. trademarks for several other “saga” games, like Bubble Witch Saga(Opens in a new window) and Pyramid Solitaire Saga(Opens in a new window), while others are pending.
Despite this month’s filing, however, a King spokeswoman told PCMag today that “we do not have any concerns that Banner Saga is trying to build on our brand or our content.” Instead, this move is an act of self-preservationan attempt to protect the IP.
“If we had not opposed Banner Saga’s trademark application, it would be much easier for real copy cats to argue that their use of ‘Saga’ was legitimate,” the spokeswoman said in a statement. “This is an important issue for King because we already have a series of games where ‘Saga’ is key to the brand.”
Stoic Studio did not immediately respond to a request for comment.
While the companies await a final verdict in their fight, King has 30 days until its “Candy” trademark is approved, provided no one objects. One app that might run afoul of that trademark is All Candy Casino Slots’ Jewel Craze Connect: Big Blast Mania Land.
