Candy Crush Saga developer King is now one step closer to trademarking the term “candy,” but those with an interest in the term can still object.
In February 2013, King filed a trademark application for “candy,” which the U.S. Patent and Trademark Office approved for publication(Opens in a new window) on Jan. 15. It’s not a done deal, though. Those who object now have 30 days to register their complaints.
The claim does not specify font style, size, or color; it simply asks for control over the word “candy” for use in software products, educational services, and clothing—including bath robes, ear muffs, shower caps, underwear, and paper hats.
According to GameZebo(Opens in a new window), Apple has already begun warning developers whose application and game titles include the word “candy,” including All Candy Casino Slots’ Jewel Craze Connect: Big Blast Mania Land.
Though it shares no gameplay similarities to King’s massively popular app, the game’s App Store icon simply reads “Candy Slots,” which, King argued, could lead to consumer confusion and damage to its brand.
King has already trademarked “Candy” in the EU, a spokesperson said, where the company’s IP is “constantly” being infringed.
“We don’t enforce against all users of ‘CANDY’—some are legitimate and of course, we would not ask Apple developers who use the term legitimately to stop doing so,” the company said in a statement. “We believe this App name [All Candy Casino Slots] was a calculated attempt to use other companies’ IP to enhance its own games, through means such as search rankings.”
Candy Casino Slots maker Benny Hsu told New York magazine(Opens in a new window) that he will change the game title if necessary, to avoid costly court fees.
A similar trademark dispute erupted several years ago, when Apple sought to trademark the term “app store.” Microsoft objected to the move, and Amazon eventually got roped in, too. Eventually, Apple put the trademark war to rest when it dropped its lawsuit against Amazon and its AppStore.
