Old wounds were reopened this week when Wikipedia released its first-ever transparency report, which cited a monkey selfie among its recent takedown requests.
The story, according to nonprofit group Wikimedia, tells the tale of a photographer’s unattended camera and a female crested black macaque monkey who took a series of photos with itincluding a self-portrait.
The images, taken in a national park in North Sulawesi, Indonesia, were later featured in an online newspaper article and eventually posted to Wikimedia Commons(Opens in a new window), an open database of media files deemed to be in the public domain.
Early this year, British nature photographer David Slater appealed to Wikipedia’s parent site, claiming copyright privileges, and asking that the monkey selfie be removed.
“We received a takedown request from the photographer, claiming that he owned the copyright to the photographs,” Wikimedia’s report said. “We didn’t agree, so we denied the request.”
But this week’s transparency report restarted a feud that began in Januarya disagreement over whom the photo actually belongs to: the monkey, the man, or all of us sitting on the sidelines, thrilled that the monkey took a selfie with the man’s camera.
“They don’t claim that they own the image. They think that everybody owns the image. It’s free to use, simply because the monkey pressed the shutter,” Slater told The Telegraph(Opens in a new window). “There’s no consideration of the effort, the skill, the technological knowledge behind it, the vision.”
And while Wikimedia is likely basing its decision on U.S. copyright law, Slater legitimately pointed out that a case like this has never been tested.
“They’re guessing,” he said.
Slater spent three days in the Indonesian wilderness in 2011, shadowing the monkeys, becoming a part of their tribe. Once comfortable with each other, the photographer set his camera on a tripod, framed the shot, and left the shutter button for the monkey to operate.
In the first year after the image was taken, Slater earned £2,000 ($3,365) in sales. But once it hit Wikipedia, “all interest in buying it went,” he told the BBC(Opens in a new window). The photographer estimated he’s lost out on a total of £10,000 or more in sales due to the designation of his photo as free to use by Wikipedia.
The now-iconic picture was featured by news outlets around the world, including The Guardian, The Telegraph, and Huffington Post, as well as on the blog Techdirt, which received a removal request from Slater, the Washington Post reported(Opens in a new window).
“The profession as a photographer, let alone a wildlife photographer, is almost unsustainable now,” he told The Telegraph.
